The Access to Information (ATI) Act allows Canadians to request copies of files which are within the government’s domain. ATI requests are often used within our industry to request copies of Product Registration Dossiers and even Health Canada Inspection Reports.   The government is obligated to compile the data requests and then provide these records to the subject of the request; so that the receiver has an opportunity to purge and prevent certain types of information from disclosure.

Section 20 of the Act outlines what types of information may qualify for purging from the disclosed record. Depending on the nature of the records being disclosed; clients are forced to sometimes involve their legal counsel to help delay or stop the disclosure of confidential records.

DSA is often asked by our clients to file ATI requests with Health Canada, and sometimes our clients are on the receiving end of these requests.
